1About CaribSys and the Scope of These Terms
CaribSys provides technology consulting, infrastructure, integration, implementation, support, and related services to organizations throughout the Caribbean and other markets.
Website information is provided for general informational and business purposes. Visiting the website or submitting an enquiry does not, by itself, create a customer, consulting, support, reseller, partnership, agency, fiduciary, or employment relationship.
Products and services supplied by CaribSys are governed by the applicable agreed proposal, quotation, statement of work, service agreement, or other commercial terms. These Terms do not replace or amend those agreements. If there is a conflict concerning a particular engagement, the terms agreed for that engagement control.

Website content, including architecture descriptions, recommendations, specifications, compatibility information, articles, examples, and case studies, is not a substitute for an assessment of your specific technical, operational, security, regulatory, financial, or business requirements.

Please do not send passwords, credentials, private encryption keys, sensitive personal information, or confidential customer or operational data through general website forms. Where sensitive information is needed for an engagement, an appropriate secure channel should be agreed first.
Submitting an enquiry does not, by itself, create a confidentiality agreement. Any personal information remains subject to our Privacy Policy and applicable law.

Subject to section 13, CaribSys disclaims warranties concerning the completeness, accuracy, availability, reliability, suitability, or continued currency of general website content, including implied warranties to the extent they may lawfully be excluded.
These exclusions do not override express commitments under a separate agreement, legally binding representations, or warranties and protections that cannot lawfully be excluded.
13Limitation of Liability and Protected Rights
To the extent permitted by applicable law, CaribSys and its directors, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or exemplary damages arising solely from access to, inability to access, or reliance on this website or its general informational content.
This includes loss of profits, revenue, business opportunities, or data where those losses constitute the categories of damages described above.
Nothing in these Terms excludes or limits liability for:
- death or personal injury resulting from negligence;
- fraud or fraudulent misrepresentation;
- gross negligence or wilful misconduct; or
- any liability, obligation, right, or remedy that cannot lawfully be excluded or limited.
Any exclusion relating to other losses caused by negligence applies only to the extent that it satisfies applicable legal requirements, including any requirement of reasonableness.
Separate commercial agreements govern liability for products and services supplied by CaribSys. These website Terms do not replace those provisions or remove mandatory consumer protections.

These Terms do not replace that policy or constitute consent to processing where separate consent is required.

Nothing in these Terms limits rights or remedies available under applicable accessibility or disability laws.

Disputes relating specifically to these Terms or use of this website are subject to the jurisdiction of the courts of Saint Lucia. This provision does not remove any mandatory right to bring proceedings in another competent court or use an available statutory complaint process.
18Severability and Waiver
If a provision is found unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law and any order of the relevant court or tribunal.
A delay or failure to enforce a provision does not, by itself, waive the right to enforce it later.
